In yet another lawsuit by Apple, the company claimed that the Motorola Xoom tablet violated the design patent that the iPad is based on. However, a German court disagreed, ruling that the Xoom doesn’t infringe on Apple’s design patent. The case wasn’t a complete victory for Motorola, however, since the court wouldn’t invalidate the patent, so it could still be used against other tablets in future. If Apple wishes to pursue suing Motorola, they will hereafter have to do so based on a multi-touch patent claim, among others.
